Parowls Software GmbH, c/o F Trust AG, 8820 Zurich, Switzerland, e-mail admin@vidrightnow.com (Company number CHE-267.553.984), a company, represented by Paul Milner as the responsible person, is the operator of the app Vidrightnow and associated website www.vidrightnow.com (together hereafter referred to as the ‘App’), and therefore responsible for the collection, processing and use of your personal data and the compatibility of the data processing with applicable law.

Your trust is important to Parowls Software GmbH. Parowls Software GmbH takes the issue of data protection seriously and pays attention to appropriate security. Of course, Parowls Software GmbH observes the legal provisions of the Swiss Federal Data Protection Act (DPA), the Swiss Ordinance to the Federal Data Protection Act (DDPA), the Swiss Telecommunications Act (TCA) and, where applicable, other provisions under data protection law, in particular the General Data Protection Regulation of the European Union (GDPR).

For better readability, the masculine form is used in this data privacy statement for personal names and special nouns. Corresponding terms apply in principle to all genders for the purposes of equal treatment. The abbreviated form of language is for editorial reasons only and does not imply any valuation.

In order for you to know what personal data Parowls Software GmbH collects from you and for what purposes it is used, please take note of the information below.

1) Principles of data processing on the app

The personal data collected on the app

a) are processed in a lawful manner, in good faith and in a way that is comprehensible to the data subject. The processing is carried out in a proportionate manner.

b) will be used solely for the implementation and processing of the services offered on the mobile app and for related advertising measures to which the user has consented.

c) which are inaccurate with regard to the purposes of their processing shall be deleted or corrected without delay.

d) are kept or stored only as long as necessary for the purposes for which they are processed.

e) are processed in a manner that ensures appropriate security, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage.

Personality profiles (compilations of data that allow an assessment of essential aspects of the personality of a natural person) are created on the mobile app (so-called profiling; cf. Art. 6 (7) lit. b DSG and Art. 4 No. 4 DSGVO). For this purpose, the express consent of the person concerned is obtained in advance (cf. Art. 6 para. 1 lit. a DSGVO).

The data processing performed on the mobile app is documented.

2) Lawfulness of data processing

By viewing the App, the user gives his consent to the processing of personal data relating to him, especially since this can also be assumed to be in the user's overriding interest.

The offers on the mobile app are aimed exclusively at persons over 16 years of age. Recognized personal data of children under 16 years will be deleted immediately.

The user has the right to revoke his consent at any time (by e-mail to admin@vidrightnow.com).

The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

3) Scope and purpose of the collection, processing and use of personal data

a) when visiting the app

When visiting the App, the servers temporarily save each access in a log file. The following data is stored without any action on the part of the user:

- the IP address of the requesting computer,

- the date and time of access,

The collection and processing of this data is carried out for the purpose of enabling the use of the App (connection establishment), ensuring system security and stability, and enabling the optimization of the Internet offering, as well as for internal statistical purposes.

b) Registration and customer account

You have the option on the app to register and thus open a customer account. The following data must be provided for this purpose:

- First and last name and

- E-mail address.

The above data is necessary for data processing. Parowls Software GmbH processes this data exclusively to make the Apps more friendly and in case the customer forgets his password.

By registering, you give Parowls Software GmbH your consent to process the data provided for the regular dispatch of promotions (online or print) to the address you have provided and for the statistical evaluation of usage behavior. This consent constitutes the legal basis for the processing of your information in the sense of Art. 6 para. 1 lit. a DSGVO. Parowls Software GmbH is entitled to commission third parties with the technical processing of advertising measures and is entitled to pass on your data for this purpose.

You can delete your profile yourself at any time. Subsequently, all data stored by and about the customer will be automatically deleted after 21 days.

4) Integration of third-party services and content

It may happen that content or services from third-party providers, such as city maps or fonts from other apps, are integrated within the online offer of Parowls Software GmbH. The integration of content from such third-party providers always requires that they perceive the IP address of the user. Without the IP address, the content cannot be sent to the respective browser. The IP address is thus required for the display of this content. Furthermore, third-party providers can set their own cookies and process the users' data for their own purposes. In doing so, usage profiles can be created from the processed data. Parowls Software GmbH uses this content as sparingly as possible and in a data-avoiding manner and selects reliable third-party providers with regard to data security.

In the context of the fulfillment of contracts, Parowls Software GmbH uses one or more payment service providers on the basis of Swiss data protection legislation and Art. 6 para. 1 lit. b. EU-DSGVO. The data processed by the respective payment service provider includes inventory data, such as the name and address, bank data, such as account numbers or credit card numbers, passwords, TANs and checksums, among others, as well as the contract, totals and recipient-related information. The information is required to complete the transactions. The data entered is processed solely by the respective payment service provider and stored by them. Parowls Software GmbH does not receive any information about (bank) account or credit card, but only information to confirm (accept) or reject the payment. Under certain circumstances, the data will be transmitted to credit agencies by the respective payment service provider. The purpose of this transmission is to check identity and creditworthiness. In this regard, reference is made to the terms and conditions and data protection information of the respective payment service provider. For payment transactions, the terms and conditions and data protection information of the respective payment service provider apply, which can be accessed within the respective app or transaction applications.

The following payment service provider is used in the present case:

5) Disclosure of data to third parties

Parowls Software GmbH will only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce the rights of Parowls Software GmbH, in particular to enforce claims arising from the relationship with you.

In addition, Parowls Software GmbH will share your data with third parties to the extent necessary when using the App to provide the services you request and to analyze your user behavior. As far as this is necessary for the purposes mentioned in sentence 1, the transfer may also take place abroad. Insofar as the App contains links to third-party apps, Parowls Software GmbH no longer has any influence on the collection, processing, storage or use of personal data by the third party after these links have been clicked on and Parowls Software GmbH accepts no responsibility for this.

6) Data security

Parowls Software GmbH uses appropriate technical and organizational security measures to protect your stored personal data against manipulation, partial or complete loss and against unauthorized access by third parties. The security measures are continuously improved according to the technological development.

You should always keep your payment information confidential and close the browser window when you have finished communicating with Parowls Software GmbH, especially if you share the computer with others.

Parowls Software GmbH also takes internal data protection very seriously. The employees and the contracted service companies are obliged to maintain confidentiality and to comply with the provisions of data protection law.

7) Cookies

Cookies help in many ways to make your visit to the App easier, more enjoyable and more meaningful. Cookies are information files that your web browser automatically stores on your computer's hard drive when you visit the App. Cookies do not damage your computer's hard drive, nor do they transmit users' personal data to Parowls Software GmbH.

Parowls Software GmbH uses cookies, for example, to better tailor the information, offers and advertising displayed to you to your individual interests. Their use does not result in Parowls Software GmbH obtaining new personal data about you as an online visitor. Most Internet browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a message always appears when you receive a new cookie.

Disabling cookies may prevent you from using all the features of the App.

8) Data transmission security with SSL

For security reasons and to protect the transmission of confidential content, this app uses SSL/TLS encryption. You can recognize an encrypted connection by the fact that the address bar of the browser changes from "http://" to "https://" and by the lock symbol in your browser bar.

If SSL or TLS encryption is activated, the data you transmit to Parowls Software GmbH cannot be read by third parties.

9) Transfer of personal data abroad

Parowls Software GmbH is also entitled to transfer your personal data to third companies (contracted service providers) abroad, provided this is necessary for the data processing described in this privacy policy and if this does not seriously jeopardize the privacy of the data subjects.

These third-party companies are obligated to the same extent as Parowls Software GmbH for data protection. If the level of data protection in a country does not correspond to that in Switzerland or the EU, Parowls Software GmbH will contractually ensure that the protection of your personal data corresponds to that in Switzerland or the EU at all times. The user expressly agrees to this, if required.

Users residing in a member state of the EU or Switzerland are advised that the USA does not have a sufficient level of data protection from the perspective of the European Union.

10) Right of access, rectification, erasure and restriction of processing; right to data portability

You have the right to receive information about the personal data stored about you by Parowls Software GmbH free of charge upon request. In addition, you have the right to have incorrect data corrected and the right to have your personal data deleted, insofar as this does not conflict with a legal obligation to retain the data or an authorization that allows Parowls Software GmbH to process the data. You also have the right to request a restriction of data processing as well as to object to data processing.

You also have the right to request the return of any data you have provided to Parowls Software GmbH. Upon request, Parowls Software GmbH will also share the data with a third party of your choice. You have the right to receive the data in a common file format.

You can also tell Parowls Software GmbH what to do with your data after your death by giving appropriate instructions.

Parowls Software GmbH stores personal data only for as long as it is necessary to use the above statistics and error tracking within the scope of the customer's legitimate interest, to perform services to the above extent that you have requested or to which you have given your consent, and to comply with legal obligations.

13) Right to complain to a data protection supervisory authority

If you are a resident of an EU country, you have the right to complain about Parowls Software GmbH's data processing at any time to the competent data protection supervisory authority in your place of residence.

If you are a resident of Switzerland, you have the right to complain about Parowls Software GmbH's data processing at any time to the Swiss Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, CH-3003 Bern.

14) Changes to this privacy policy

This privacy policy is not part of any contract. We may amend this Privacy Policy at any time. The version published on this app is the current version.

15) Authoritative version

If this Privacy Policy is translated into different languages, only the German version shall be authoritative.
